Terms of Service

1. Definitions

In these Terms, the following definitions apply:

• "Service" means the Preplyer platform, including the website, applications, and all features and functionality related to AI-powered interview practice (mock sessions, feedback, analyses, and related tools).
• "User", "you", or "your" means the individual or entity accessing or using the Service.
• "We", "us", or "Preplyer" means the operator of the Service.
• "Credits" means the in-platform units used to consume paid features of the Service (e.g. running interview sessions or generating analyses).
• "Content" means any data, text, or materials you submit or generate through the Service, including interview responses and session inputs.

2. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

3. Description of the Service

Preplyer provides an AI-powered interview practice platform. The Service may include: configuring and running mock technical or behavioral interviews, receiving AI-generated feedback and analyses, purchasing and using credits, and subscribing to paid plans. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.

4. Account and Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized access or use. We are not liable for any loss or damage arising from your failure to protect your credentials or from unauthorized use of your account.

5. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems or networks.
• Use the Service to generate, submit, or store content that is illegal, harmful, offensive, or infringes third-party rights.
• Resell, sublicense, or commercially exploit the Service or any part of it without our prior written consent.
• Use automated means (e.g. bots or scrapers) to access or use the Service in a manner that could impair or overload our systems.

We may suspend or terminate your access if we reasonably believe you have violated these terms or engaged in conduct that is harmful to the Service or other users.

6. Payments, Credits, Subscriptions

Paid features of the Service may require the purchase of credits or a subscription. Prices, credit consumption, and subscription terms are published on our pricing page and may change with notice. By purchasing credits or a subscription, you agree to the applicable payment terms.

Fees are generally non-refundable. We may, at our discretion, issue refunds or credit adjustments where required by law or as stated in a separate refund or cancellation policy. Credits and subscription benefits are for your personal use and may not be transferred or sold.

7. Intellectual Property

The Service, including its design, features, software, text, graphics, and branding, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from our materials without our prior written permission.

You retain any rights you hold in Content you submit. By submitting Content, you grant us a license to use, process, and store that Content as necessary to provide and improve the Service and as described in our Privacy Policy.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Preplyer is a practice and preparation tool. We do not guarantee that use of the Service will result in any particular interview outcome, job offer, or career result. AI-generated feedback and analyses are for informational and educational purposes only and should not be relied upon as professional or legal advice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Preplyer and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service or these Terms, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from or related to the Service or these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or, if you have not paid us, one hundred United States dollars (USD 100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Preplyer and its affiliates and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your Content or your violation of these Terms; or (c) your violation of any third-party right or applicable law.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may close your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including Sections 7–10 and this sentence) will survive termination.

12. Changes to the Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may also be communicated by email or a notice within the Service. Your continued use of the Service after the effective date of changes constitutes your acceptance of the revised Terms. If you do not agree to the new terms, you must stop using the Service.

14. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Preplyer operates, without regard to its conflict of law principles.
